They put Muñoz in the same prison in Santa Rosalia as where his employees are incarcerated. That should be interesting.

Very interesting. He is such a dangerous man. Yet, in the first picture above they have a couple of 7 year old children walking behind him, all within two feet of him.

This is the Baja California Sur penal code that Muñoz is being charged with:

CAPÍTULO V
DESPOJO
ARTÍCULO 314.- Se impondrá prisión de uno a seis años y multa hasta por cien días de salario mínimo vigente, al que por medio de la violencia física o moral, la furtividad o el engaño, realice cualquiera de las siguientes conductas:
I.- Ocupe un inmueble ajeno, haga uso de él o de un derecho real que no le pertenezca;
II.- Ocupe un inmueble de su propiedad en los casos en que la ley no lo permita por hallarse en poder de otra persona o ejerza actos de dominio que lesionen los derechos del ocupante; o
III.- Desvíe o derive en su provecho aguas ajenas o ejerza actos de dominio respecto de aguas propias, lesionando los derechos de otros.


CHAPTER V
DISPOSSESSION
ARTICLE 314 - There is imposed a prison term of one to six years and a fine of up to 100 days of the current minimum salary, to anyone who through physical or moral violence, stealth or deception, does any of the following acts:
I. Occupies a real property not owned, make use of it or of an ownership right that does not belong to him.
II. Occupies a real property owned in cases where the law does not permit control over another person or to exercise control which injures the rights of the occupant, or
III. Divert or use waters of others, or exercise control of water rights owned which injures the rights of others.

In my opinion, the arrest of Rafael Martinez is a purely political arrest because he had the temerity to call the Baja California Sur Governor and Prosecutor corrupt. What a wonderful country to live in where the government protects the dangerous criminals and those that complain arrested. What a shithole! You cocksuckers over you know where who disagree, fuck you very much! You know who you are!

On 1/5/2016, Jihad answered my two questions for legal purposes. Are you inviting me to come over to your house for coffee? And, are you saying I can turn the doorknob of your front door and just walk into your house without knocking first? After he said I could, I went over in the pouring rain and he was again too scared to unlock the door. Needless to say I did not get to have my cup of coffee.

Jihad Joe loves to hate Raphael but fails to see the similarities here between Tila and Raphael. Plug this into the Playa Buenaventura case: Olivia=Alonzo: the FMZ title holder, Mark=Woooosh: the American spouse (but Woooosh didn't run to the US Embassy), and Raphael=Tila- the unwelcome Mexican trying to steal the concession using intimidation and violence with Harlan, Eduardo and the Rosarito Police (who have already admitted wrongdoing and apologized) . Tila should start her defense team working on the charges posted for Raphael, they are likely the same she is facing- with 5-9 years jail time. That's just the unlawful possession part using violence. Tila also tried to sell National Land, which is another 5-9 years. She also obtained documents to take National Land already in a Federal Zone Concession by method of "Prescription", which is another 5-9 years. If the Director Generals of PROFEPA and ZOFEMAT decide to prosecute her for lying in her sworn affidavits, that would be an additional charge or two. Should Alonzo decide to sue Tila for defamation over those same false affidavits (accusing Alonzo of intentional fraud to steal her house when Alonzo had never applied for that area), that would be a lesser civil action.

Mexico is blessed as being one of the most beautiful countries in the world. It has some of the most loving, caring, and generous people in the world. It is a shame that all the thieving blood suckers ruin it for all the good people, and they far outnumber them. The USA is rapidly heading the same direction.

If you mean Tila- she's a Texan who hangs out with deportees and bottom feeders who couldn't make it stateside. None of the bullshit around me is caused by real Mexicans. What's a shame is the stupid Mexican's who rent to them and further lower their property value.

The are really giving Rafael Muñoz a hard time:

La Paz, Baja California Sur.- Al abandonar el Centro de Reinserción Social -CERESO- de Santa Rosalía, Baja California Sur, Rafael Muñoz Martínez, alias "El Mano Negra", fue reaprehendido la tarde del día 14 de junio de 2012 por elementos de la Policía Ministerial del Estado, por exhorto de la Procuraduría General de Justicia de Baja California, por existir en su contra una orden de aprehensión girada por el Juez Tercero Penal de la ciudad de Tijuana, Baja California.

Es presunto responsable por el delito de fraude equiparado. Eduardo García Barraza su abogado, declaró a El Sudcaliforniano que a su cliente "le violentaron sus garantías individuales, porque los supuestos agentes aprehensores no se identificaron como Agentes de la Policía Ministerial del Estado, ni exhibieron ninguna orden de aprehensión".

Además dijo, "Rafael está amparado por el Juez Tercero de Distrito con residencia en esta plaza, contra cualquier acto de autoridades que lo privaran de su libertad ya sea aprehensión, presentación o arresto pero aún así, lo aprehendieron".

Rafael Muñoz Martínez, de 53 años de edad, alias "El Mano Negra", fue aprehendido el pasado 10 de junio de 2012 en la ciudad de México, D.F., por elementos de la Policía Ministerial del Distrito Federal y entregado a agentes de la Policía Ministerial del Estado para su traslado al Centro de Reinserción Social de Santa Rosalía, Baja California Sur.

En la presente causa penal es presunto responsable por el delito de despojo de fecha 22 de enero de 2009 de un predio denominado "La Tinaja", ubicado en carretera Transpeninsular, kilómetro 91, Bahía Concepción, municipio de Mulegé, Baja California Sur.

El pasado 14 de junio el licenciado Víctor Flores Aguilar, titular del Juzgado Mixto de Primera Instancia de Santa Rosalía, Baja California Sur, le dictó auto de formal prisión, por su presunta responsabilidad en la comisión del delito de despojo por el cual pagó una fianza y obtuvo su libertad la cual duró menos de 15 minutos, porque inmediatamente fue reaprehendido.

Se prevé que de hoy a mañana será trasladado al Centro de Reinserción Social de la ciudad de Tijuana, Baja California, por vía aérea. Ayer, aún se encontraba en la celda o separos de la Policía Ministerial del Estado.

La Paz, Baja California Sur. - Upon leaving the Santa Rosalia, Baja California Sur prison, Rafael Muñoz Martínez, alias "El Mano Negra," was rearrested the afternoon of June 14, 2012 by State Ministerial Police at the insistence of the Baja California Attorney General, as there were previously existing arrest warrants issued by the Third Penal Judge of Tijuana, Baja California.

He is presumed to be responsible for land fraud. Eduardo García Barraza, his attorney, told El Sudcaliforniano that his client "had his individual rights violated, because the supposed police agents who arrested him did not identify themselves as state ministerial police, nor did they show an arrest warrant."

In addition, he said, "Rafael has a writ of habeus corpus by the Third District Judge with jurisdiction in this matter, which is protection against any act of the authorities who would deny him his liberty, be it detention, appearance or arrest, but they still detained him."

Rafael Muñoz Martínez, 53 years old, alias "El Mano Negra," was arrested last June 10, 2012 in Mexico City by elements of the Ministerial Police of Mexico City and delivered to Ministerial Police of Baja California Sur for his transfer to the Santa Rosalia prison.

In the current criminal case, he is presumed responsible for the crime of dispossession on January 22, 2009 for a property named "La Tinaja," located at kilometer 91 on the Transpennisular Highway, Bahia Concepcion, municipality of Mulege, Baja California Sur.

Last June 14, Víctor Flores Aguilar, head of the Mixed Court of the First Instance in Santa Rosalia, Baja California Sur, ordered Muñoz be detained for his presumed responsibility for the crime of dispossession, and Muñoz paid bail and was freed for 15 minutes, as he was immediately rearrested.

It is expected that today or tomorrow he will be transferred to the Tijuana prison by airplane. Yesterday, he was still being held in the State Ministerial Police jail.
