How LaDoctora's day in court started out bad and then went downhill from there.

From the beginning, LaDoctora had insisted upon a jury trial, while defendants Fulano and Woooosh did not want nor request a jury trial.

The first thing the judge said, before LaDoctora could even open her mouth, was that he would not allow a jury trial. He gave along, 15-minute explanation of why he would not allow a jury trial. The Reader's Digest version is that he had reviewed all the filings and LaDoctora's documentation was insufficient. He specifically cited a lack of proper jury instructions, which were to be provided by the Plaintiff.

At lunch, still fuming from not getting her jury trial, she called some attorney who advised her to ask for a continuance of the trial. When she told the judge after lunch that she had talked to an attorney and wanted a continuance to preserve her rights, the judge outright denied her motion, saying, "The trial has already started."

The downhill slide continues....

So, LaDoctora has subpoenaed six witnesses to testify on her behalf at the trial. Two of the witnesses showed up and four totally ignored their subpoena and failed to appear. The four who failed to appear are:

Jihad E. Salman
Tila Ortiz
Dawn Sayre (her key witness on damages)
Doug Means

Right after the judge gave LaDoctora the bad news that there would be no jury trial, she had the bailiff hand the judge the four witness subpoenas of those who failed to appear and asked the judge to sanction all four of the witnesses. The judge reviewed the subpoenas and said he would have the clerk commence processing sanctions on only Jihad E. Salman, who was subpoenaed by her on June 11, 2017.

Of the two witnesses who did show up:
Scot Richardson
Bob Yourell
After about two probative questions from the judge, he determined those two witnesses had no evidentiary information to provide and refused to let them testify. They were hurried on their way back to Mexico without ever saying a word in court. In other words, the judge was not going to let Scot and Bob do a celebrity roast of Fulano and Woooosh just because they did not like us and had a hair up their asses.

The judge asked both sides who their witnesses would be. Instead of just being grateful for the two people who did show up and keeping her mouth closed about the no-shows, LaDoctora threw Jihad et al under the bus. I'm pretty sure Jihad has permanent tread marks.  I hear a gerbil may have met his demise. The judge asked her if the witness fee of $75 had been paid and she said Jay Salman of Temple City wanted thousands of dollars to appear. I think she may have said it was $2000.  It was one of those out-of-the-blue utterances you almost miss becasue you aren't expecting it. She did ask the judge to sanction all four no-shows for non appearance, handed the original of each summons to the Bailiff- who presented them to the Judge  What an opening act that was. The trial of the century had not even started and LaDoctora's fate reaches its nadir....

LaDoctora finds out Fulano had already won his case seven months before the trial started.

One common pretrial legal procedure is to serve a Request for Admissions on the opposing party. This serves to narrow down the scope of the matters at issue. In a Request for Admissions, the opposing party is asked to either admit or deny the facts or allegations in the Complaint. Those facts which are admitted, no longer need to be tried as they are uncontested.

In October, 2016, Fulano served LaDoctora with his Request for Admissions. In the Request, Fulano listed every allegation in LaDoctora's  complaint and asked her to admit that they were untrue. LaDoctora had a fixed period of days to respond to the Request. When she failed to respond, Fulano then filed a Motion to Deem Facts Admitted with the court. LaDoctora had a specified period of time to file her objections to that Motion, which she also did not do. At the hearing in January, 2017 on Fulano's Motion to Deem Facts Admitted the court granted Fulano's motion and further sanctioned LaDoctora $70 for her failure to respond to the Request for Admissions.

At the trial on July 25, 2017, after the judge gave LaDoctora the bad news that there would be no jury trial and her witnesses would not testify, Fulano asked the court to addresss his Motion to Deem Facts Admitted. Technically, this was a Motion in Limine, a motion filed by a party to a lawsuit which asks the court for an order or ruling limiting or preventing certain evidence from being presented by the other side at the trial of the case.

The judge looked at his Order to Deem Facts Admitted, and stated: "Well, I see there are no more triable issues as to Fulano. Fulano, you are dismissed from this lawsuit." This was less than one-hour into the Trial of the Century.
